Prohobition Of Discrimination In Turkish Law” Seminar Was Held In GAU

“Prohibition of Discrimination in Turkish Law” seminar which was organized by Girne American University (GAU) Faculty of Law, was given by Istanbul Bilgi University Vice Dean of the Faculty of Law and Expert of Human Rights Law Assist. Prof. Dr. İdil Işıl Gül.

GAU Member of Board and Vice Rector Assoc. Prof. Dr. Hossein Sadri was performed the opening speech of the seminar. He emphasized that GAU’s 2015-2016 Academic year theme is “Human Rights and Child Rights” and he indicated that this organization is so important at this point. Sadri said that they continue to invite academicians and non-governmental organizations that have done important studies about human and child rights to GAU.

 

Sadri in his speech, “In seminar that we will perform today within the scope of 2015-2016 academic events, Istanbul Bilgi University Vice Dean of the Faculty of Law and Expert of Human Rights Law Assist. Prof. Dr. İdil Işıl Gül will give “Prohibition of Discrimination in Turkish Law” themed seminar. Teacher Işıl is a precious person who works in Human Rights Law Research Center, at the same time she is known with her activities and publications especially with her works on discrimination and I also follow her closely. First of all I thank her for accepting our offer and coming to our school and also I thank her for showing interest in our students.”

 

Istanbul Bilgi University Vice Dean of the Faculty of Law and Expert of Human Rights Law Assist. Prof. Dr. İdil Işıl Gül, in her presentation, said that there are some laws to regulate prohibition of discrimination as open and detailed and some of those are civil rights agreement, elimination of racial discrimination, removal contract to eliminate all forms of discrimination against women and she said that Turkey is a side of all of them.

 

Gül in her speech, “There are concepts that you should know while you are talking about the prohibition of discrimination. Those are: quality prohibition, equal opportunities, equality in results and special measures to eliminate the inequalities. There are different discrimination types in present proposed law. We generally think discrimination as factionalism but sometimes If we act a person as same as we act another person, the person may can’t benefit from rights and freedom. For example, If I don’t read the visual presentation to the blind student, he can’t benefit from the presentation. Purpose in the prohibition of human rights discrimination is every individual can benefit from their rights and freedom in the same way as equal.”

 

 “When we mention to proof topic, if you are Alevi or homosexual in Turkey you may be discriminated. You know that people are sensitive about this issue, you also know that you are discriminated but how will you prove it? You can’t prove absolutely. You know that proof rule in Turkey is like; everyone is obliged to prove their claim. If I claim that I am discriminated because I am homosexual, I could never prove it. Therefore, when discrimination in question, we say that burden of proof needs to be replace and if burden of proof in regulations don’t replace, that regulations can never be valid.”
